Counsel for the applicant bank has filed the affidavit of Shri Riyaz Ahmad, Manager, and has made a statement at the Bar, that defendants have paid the overdue amount and account of the defendants has been upgraded and he does not want to pursue the present OA. Accordingly, the OA filed by the applicant bank is dismissed as withdrawn . In case, defendants fail to make the payment in installments regularly, bank would be free to file OA again for recovery of its dues. Registrar is directed to refund the court fees as per rules.
