The Applicant Bank filed the^present OA for the recovery a total sum of Rs.5,98,16,089.09ps i.e., a sum of Rs.3,25,95,032.49ps towards Term Loan with future interest @13.25%^p.a. and a sum of Rs.2,72,21,056.60ps towards Occ/Working Capital^Loan with future interest @12.25olo^p.a. from the defendants^jointly and severally with monthly rests from 07.O2.2025 till the^date of realization along with costs and in default for sale of OA schedule^properties.

Summons served on D1 to 5. They were set ex-parte^on 14.07.2025 as called absent and no representation.

The Applicant Bank examined Banavath Sai Kiran,^Asst. Manager, as AW-1 and marked 49 documents through him as Ex. A.1 to Ex. A.49.

Ld. Counsel for the Applicant Bank reported orders may^be passed through merits. Perused the material placed on record.

The point that arises for consideration is:-

the Defendants and OA schedule properties?

As stated supra, the Defendants remained ex-parte. The Evidence Affidavit coupled with the recitals in the documents viz., Exs. A.1 to A.49 marked on behalf of the Applicant Bank clinches the claim of the Applicant Bank against the Defendants. Hence, I hold that the Defendants are jointly and severally liable to pay the OA claim to the Applicant Bank with future interest and costs.

In the result, the present Original Apptication No.191/2025 is allowed as under: -

i) The Defendants are joinuy and severally liable to pay to the Applicant Bank a total sum of Rs.5,98,16,089.09ps i.e., a sum of Rs.3,25,95,032.49ps towards Term Loan and a sum of Rs.2,72,21,056.60ps towards OCC/Working Capital Loan; with future interest 6119.65o70 p.a. simple from the date of application till the date of realization;
