On 20.09.2017, bank had granted a loan of Rs.25.00Lacs in the form of Overdraft Cash Credit Limit to defendant No.1 through its proprietor i.e. defendant No.2 for Business purpose. On 04.08.2018, the O.C.C. limit was enhanced from Rs.25.00 Lacs to Rs.35.00 Lacs. Again on 10.06.2020, bank had granted loan of Rs.7.00Lacs in the form of Working Capital Term Loan under GECL Scheme to defendant No.1 through its proprietor i.e. defendant No.2 for Business purpose. To secure the loans, Defendant No.3 had mortgaged his property (fully detailed in para No.3A of the application). Defendant No.3 stood as guarantor for all the facilities. The loans were chargeable to different rates of interest. Defendants had duly acknowledged their liability towards the debt on 06.07.2018 & 03.12.2019 & 01.03.2021 & 03.07.2021. On 31.07.2022, a sum of Rs.47,15,094.84p was due from the defendants. Despite repeated requests, defendants did not make the repayment. Hence, this application.
