This original application is filed on 12.06.2018 by the applicant bank under Section 19 of Recovery of Debts and Bankruptcy Act, 1993 (formerly Recovery of Debts Due to Banks and Financial Institutions Act, 1993) against the defendants for recovery of a total sum of Rs.87,51,858.85p (Rupees Eighty Seven Lakhs Fifty

(i) directing the defendants 1 to 7 jointly and severally to pay to the applicant a sum of Rs. 58,20,666.85p due as on 11.06.2018 together with interest thereon at the rate of 18.60% p.a. with monthly rests together with penal interest at the rate of 2% p.a. from the date of filing of OA till the date of realisation towards Term Loan Over Draft facility – TMB SME Loan Account No.227700050900112;

(iii) directing the defendants 1 to 7 jointly and severally to pay to the applicant a sum of Rs.3,30,640/- due as on 11.06.2018 together with interest thereon at the rate of 12.85% p.a. with monthly rests together with penal interest at the rate of 2% p.a. from the date of filing of OA till the date of realisation towards TMB Vehicle Term Loan Account No.227700460100004;

and for sale for mortgaged property morefully detailed in schedule to the OA, for an order permitting applicant bank to proceed against defendants 2 to 7 and for costs of this application.

Brief Facts of the case:

The Applicant submits that the application is filed within the period of limitation as prescribed under Section 24 of the Recovery of Debts and Bankruptcy Act, 1993, and the subject recovery claim falls within the jurisdiction of this Hon’ble Tribunal.

The case of the applicant bank is that the 1^st Defendant is a Proprietary concern involved in business of running Super Market, represented by its Proprietrix Mrs. Arul Mozhi, 2^nd defendant in the OA. The defendants approached the applicant

bank seeking financial assistance for business purpose.

It is submitted that upon request of defendants, the applicant bank had sanctioned four credit facilities under various heads as follows:

(i) Term Loan – TMB Genset for Rs.2,67,000/- vide Loan Account No.227700480100082 on 07.05.2015;

¶44

(ii) Over Draft Facility – TMB SME for Rs.27,00,000/- vide Loan Account No.227700050900112 on 12.06.2015, which was subsequently enhanced to Rs.47 lakhs on 08.10.2015;

(iii) Term Loan – TMB SME for Rs.13,00,000/- vide Loan Account No.227700480100087 on 12.06.2015; (iv) TMB Vehicle Loan for Rs.5,45,000/vide Loan Account No.227700460100004 on 28.08.2015.

It is submitted by applicant bank that 1^st credit facility in nature of Term Loan vide Loan Account No.227700480100082 was closed on 07.10.2016 upon payment made by the 1^st defendant.

It is further submitted by applicant bank that to secure the 2^nd credit facility - Over Draft Facility – TMB SME for Rs.27,00,000/- defendants acceding to the terms and conditions of the Sanction Letter dated 12.06.2015, executed the following loan and security documents on 12.06.2015 in favour of applicant bank:

Applicant bank submits that in order to secure the above Overdraft facility, 7^th defendant extended the immovable property belonging to him morefully described in schedule to OA and created equitable mortgage by deposit of title deeds vide Deed of Mortgage dated 12.06.2015 registered as Document No.7043 of 2015 at SRO, Chengalpattu. The overdraft facility is repayable in 12 months from 12.06.2015 together with interest @ 18.50% p.a. and penal interest @ 2% p.a. The above Overdraft facility is also secured by Hypothecation of primary securities i.e., Products,

It is further submitted that at the request of the defendants, the above Overdraft credit facility was further enhanced to Rs.47 lakhs on 08.10.2015. The defendants executed yet another equitable mortgage by deposit of title deeds dated 12.10.2015 registered as Document No.12120 at SRO, Chengalpattu.

It is further submitted by applicant bank that to secure the enhanced limit of Rs.47 lakhs, defendants acceding to the terms and conditions of the Sanction Letter dated 08.10.2015, executed the following loan and security documents on 08.10.2015 in favour of applicant bank:

It is submitted by applicant bank that 7^th defendant extended the mortgage already created in respect of immovable property and executed Mortgage Extension Letter dated 08.10.2015 to that effect. In addition, 7^th defendant also created equitable mortgage by deposit of title deeds in respect of the property situated at Singaperumal Kovil Village, Chengalpet Taluk, Kancheepuram District – 603 204 on 12.10.2015. The overdraft facility is repayable in 12 months from 08.10.2015 together with interest @ 18.60% p.a. and penal interest @ 2% p.a. The above Overdraft facility is also secured by Hypothecation of primary securities i.e., Products, Stock in Trade and Goods of the borrower.

It is submitted by applicant bank that to secure the 3^rd credit facility – Term Loan – TMB SME towards Working Capital for Rs.13,00,000/-, defendants acceding to the terms and conditions of the Sanction Letter dated 12.06.2015, executed the following loan and security documents on 12.06.2015 in favour of applicant bank:

Applicant bank submits that the above Term Loan facility is repayable in 60 equated monthly installment at Rs.29,314/- per month commencing from 12.07.2015 and ending on 12.06.2020. The defendants agreed to repay the above loan together with interest at the rate of 12.60% p.a. and penal interest at the rate of 2% p.a. The above Overdraft facility is also secured by Hypothecation of primary securities i.e., Products, Stock in Trade and Goods of the borrower.

It is submitted by applicant bank that to secure the 4^th credit facility – TMB Vehicle Finance towards purchase of Tata Super Ace Mint BSIV Load Vehicle for Rs.13,00,000/- availed on 28.08.2015, defendants acceding to the terms and

Applicant bank submits that the above credit facility availed by defendants, 7^th defendant extended the immovable property standing in his name vide consent letter dated 28.08.2015. TMB Vehicle Term Loan facility is repayable in 60 equated monthly installments at Rs.12,539/- per month commencing from 28.09.2015 and ending on 28.08.2020. The defendants agreed to repay the above loan together with interest at the rate of 12.85% p.a. and penal interest at the rate of 2% p.a. The above Term Loan facility is also secured by Hypothecation of the Vehicle purchased under

the loan amount i.e., TATA Super Ace Mint BS IV bearing Registration No.TN-07-CC8437.

It is submitted by applicant bank that by virtue of Deed of Hypothecation of Machinery, Accessories and Tools, 1^st defendant has created a charge in favour of the Bank over the hypothecated movables / equipment, which were purchased out of the credit facilities sanctioned by the bank.

It is the case of applicant bank that defendants, after availing the said facilities, was irregular in repayment and servicing the loan extended by the applicant bank and inspite of repeated reminders, the 1^st defendant failed and neglected to regularize the same. In view of the default, the loan account was classified as NPA w.e.f. 31.08.2016. The default in repayment continued and there was no positive response from the defendants. Hence, this Original Application (OA) has been filed to recover the dues from the defendants.

It is submitted by applicant bank that in view of continuing default by the defendants, the applicant bank seized the hypothecated vehicle i.e., Tata Super Ace Mint BS IV bearing Registration No.TN-07-CC-8437 and sold the vehicle in public auction on 15.11.2017 and a sum of Rs.2,46,000/- to the respective loan account on the date of realization.

After the filing of the OA, summons was sent to the Defendants 1 to 7 through Registered Post with Acknowledgment Due, which was returned unserved with postal endorsement as ‘addressee left without instructions’. Applicant bank had caused paper publication of the notice and filed proof thereof. When OA was taken

up on 05.08.2022 even after giving sufficient time, there was no appearance or representation from the defendants. Hence, defendants 1 to 7 were placed ex-parte on 05.08.2022.

Heard the submissions of Applicant Bank and perused the records.

¶138

To prove the case of the Applicant Bank, Shri. Sanjeevi Kumar, Branch Manager, has filed his Affidavit by way of evidence and same was considered as evidence of AW-1 and list of documents came to be marked as Ex A-1 to A-54 . As the defendants remained ex-parte, the OA claim remains unchallenged. There is no contra evidence available on record to repudiate the claim of the Applicant Bank.

During the pendency of OA, applicant bank had reported part satisfaction of OA claim in a sum of Rs.83,60,000/- by way of sale of mortgaged property under SARFAESI Act on 14.12.2020. It is also submitted in the part satisfaction memo filed by applicant bank that the 7^th defendant in the OA had challenged the sale notice in SA No.92 of 2021, which came to be dismissed on merits by this Tribunal vide order dated 25.11.2021.

With regard to the amount advanced, the interest applied, the conduct and operations in the account and the default committed, this Tribunal comes to the conclusion that the applicant bank is entitled for a final order on the following terms:

(b) The sum of Rs.83,60,000/- realized by way of SARFAESI sale is directed to be given credit to the borrower’s loan account as on the date of realization.

(c) The applicant bank is at liberty to sell the personal assets of the defendants (both movable and immovable) to recover the dues as required under law;

(d) The applicant bank shall file the latest memo of calculation of OA amount together with interest, costs etc., to be paid by the defendants duly considering the amounts, if any, paid by the defendants and/or amount realized by sale of assets etc., during the intervening period after the filing of the OA, enabling the Registry to prepare Recovery Certificate for the amount to be paid by defendants to the applicant bank.

(e) The applicant bank shall file memo of costs within ten days from the date of this final order.

(f) Recovery Certificate shall be drawn up and issued to the Recovery Officer in terms of the final order.
