The Applicant Bank filed the present OA against Defendants for recovery of a total sum of R.s.8,69,O5,649.83ps (Rupees Eight Crores Sixty Nine Lakhs Five Thousand Six Hundred Forty Nine and paise Eighty three only) i.e.,

a) A sum of Rs.30,57,632.80ps under short term crop loan with further interest @ 12.30o/o p.a with monthly rests from 17.OL.2O2S till the date of realization.

b) A sum of Rs.3,23,36,934.80ps with further interest @ 12.30o/o p.a with monthly rests from L7.0t.2025 till the date of realization.

c) A sum of Rs.359,02,926.16ps with further interest @ 12.30o/o p.a with monthly rests from 17.0t.2025 till the date of realization.

2' As per the averments in the application, the Applicant Bank states that defendant no.1 is a Society represented by defendant no.2 as president and defendant no.3 as vice-president availed term loan of Rs,10,01,68,000/-. Defendants 1 to 3 executed pronote, memorandum of agreement, deed of assignment etc on 03.0g.2012. Defendants No.4 to 12 are directors of defendant no.1 society. The defendants again availed crop loan facility of Rs.11,50,46,000/- on 13,07.20t3, Rs.1.00 crore on 22.OL.ZOL6 and executed necessary documents. The defendants again short term crop facility of Rs.2.50 crores. After availing the loan facility, the defendants failed to comply the terms of sanction, hence the applicant bank classified the account as NPA on 01.04.2022 and issued notices, Inspite of several requests and demands, the defendants did not clear the outstanding. Hence this OA.
