The Applicant Bank filed the present OA against Defendant for recovery of a total sum of Rs.26,85,O35/- (Rupees Twenty Six Lakhs Eighty Five Thousand and thirty five only) with future interest @ 11.15olo p.a with monthly rests from date of filing of OA till the date of realization.

As per the averments in the application, the Applicant Bank states that defendant availed Personal loan of Rs.25.00 lakhs vide letter of arrangement dated 30.12.2023 and agreed to repay in 72 EMIs of rs.47,778/- commencing from 30.01.2024. After availing the loan facility, the defendants failed to comply the terms of sanction, hence the applicant bank classified the account as NPA and legal notice was issued on 13.02.2025. Inspite of several requests and demands, the defendants did not clear the outstanding. Hence this oA.

Defendant called absent and set exparte on 11.07.2025.

Sri BM. Ravinder, Manager of the Applicant Bank examined himself as AW.1 and exhibited relevant documents, which are marked as Ex.A.1 to A.7.

Defendant remained exparte.^{To substantiatethe case of the} Applicant Bank, AW.1, official of^{the Applicant Bank was examined} and he exhibited relevant documents^{as Ex.A1to A.7. In view of the} above, I hold that the^{Applicant Bank has established their claim} made in the OA against the^{Defendant and hence the ApplicantBank} is entitled to recover the^{claim madein the OA with futureinterest} and costs.

B. In the result, the^present OA^is allowed^{with costs, as under:} The Defendant is liable to^{pay to the Applicant Bank a total sum of} Rs.26,85,O35/-^(Rupees Twenty^{Six Lakhs EightyFive} Thousand and thirty five onty)^{with future interest@ 11.15o/o} P.a from date of filing of OA till^{the date of realization} ;

The Applicant Bank is also^{entitled to proceed againstthe person} and^properties of defendant^{towards realization of the debtdue.}

The Applicant Bank^{is entitledto the costs of the OA.}

The Applicant shall file^{a cost memo within two weeks from the date} of receipt of order.
