2.Aspertheavermentsintheapplication,theApplicantBankStates that defendant^{availed personal loan under for asum of} Rs.10,40,000 l- on^{26.05.2022. To secure the due repaymentof loan} facility,thedefendantexecutedpersonalloanagreementdated 26.05.2022. The^{defendant again availed personal loan of} Rs.24,50,000/- vlde^{letter of arrangementdated 30'08'2022'After} availing the^{loan facility, the defendantfailed to complythe terms of} Sanction,hencetheapplicantbankwasconstrainedtoclassifythe accountaSNPAandissuedlegalnoticedated04.0l.2025.Inspiteof severalrequestsanddemands,thedefendantdidnotclearthe outstanding.^{Hence this OA.}

The point that arise for consideration is whether the Applicant Bank is entitled for the claim made in the OA against the Defendant as prayed for?

Defendant called absent and set exparte. To substantiate the case of the Applicant Bank, AW.1, official of the Applicant Bank was examined and he exhibited relevant documents as Ex.A1 to A.13. In view of the above, I hold that the Applicant Bank has established their claim made in the OA against the Defendant and hence the Applicant Bank is entitled to recover the claim made in the OA with future interest and costs.

B. In the result, the^present OA is allowed with costs, as under: The Defendant is liable to pay to the Applicant Bank a total sum of Rs.29,O8,475l- (Rupees Twenty Nine Lakhs Eight Thousand Four Hundred and Seventy five only) i.ea sum of Rs.8,32,252/with further interest @ 11.30o/o p.a from date of application till the date of realization and a sum of Rs.20,76,223/- with further interest @ 11.80%^p.a from date of applicationtill the date of realization.

9, The Applicant Bank is also entitled to proceed against the person and properties of defeniCant toward realization of the debt due.
