The brief facts of the OA are that the defendants had approached the applicant for the grant of (KCC) Limit to Rs.22.00 Lacs. 3. The applicant sanctioned the KCC Limit of Rs.22.00 Lacs vide Letter of Intent dated 02.12.2014, which is Annexure A2 to this OA and terms and conditions were duly accepted by the defendant. 4. Defendant No. 1 mortgaged his immovable property i.e. Total land measuring 7K-15-2/3M situated at Village Naulakha, Tehsil and District Fatehgarh Sahib, Punjab vide Declaration under Section 4 (1) dated 03.12.2014 along with its English Translations, which is Annexure A3 to this OA. Documents executed:- Deed of Hypothecation, Guarantee Agreement, Demand Promissory Note, Letter, Affidavit all dated 09.12.2014, which are Annexures A4 to A8 to this OA; DPN dated 25.07.2017, which is Annexure A9 to this OA; Acknowledgement of Debt cum Revival Letter dated 25.07.2017 and 08.11.2018, which is Annexure A10 to this OA; Recall Notice dated 27.12.2021 along with Postal receipts, which is Annexure A11 to this OA; Guarantee Invocation letter dated 27.01.2022, which is Annexure A12 to this OA and Account Statement, which is Annexure A13 to this OA.
