The Ld. Counsel for the applicant bank submits that the defendant no. 1 and 2 approached the applicant bank for One Time Settlement for a sum of Rs.28,50,000/- including legal expenses of Rs.63,00,000/- to seftled the loan account. It is submitted that the applicant bank has received entire OTS amount of Rs.28,50 Lac and hence released its charges over mbrtgaged or charged Unit/Flat bearing No. Y-1002-Earth Towne, 10sFloor, area measuring 1295 Sq. feet, in the Project Name Eafth Towne, situated at Plot No.GH-04, Sector-l Greater Noida, Gautam Budh Nagar UP, in ftvour of the defendant no.l and 2. It is submitted that enUre OTS amount recovered and mortgaged or charged property/flat released and hence nothing remains to be adjudicated for any further recovery from the defendants and applicant bank does not want to prosecute present original application against defendants. Hence this application is being filed for early hearing and for withdrawal of the original applicaUon being settled. He further submits that he wish to withdraw the present OA.
