The brief facts of the OA are that the defendants had approached the applicant for the grant of KCC Limit of Rs.24.72 Lacs & Agriculture Term Loan of Rs.20.83 Lacs vide Loan applications dated 21.02.2023, which are Annexures A1 & A4 to this OA. 3. The applicant sanctioned the KCC Limit of Rs.24.72 Lacs & Agriculture Term Loan Limit of Rs.18.30 Lacs vide letters of arrangement dated 04.07.2023, which are Annexures A2 & A5 to this OA. 4. Defendants had mortgage their immovable properties i.e. land measuring 09K-13M-5Sarsai detailed as under: - (i) Land measuring 07K-05M-5Sarsai (in the name of defendant no. 1) situated at Village Bana, Hadbast No.416, Tehsil Balachaur, District SBS Nagar, Punjab vide declaration u/s 4(1) dated 30.06.2023, along with its translation which is Annexure A8 to this OA. (ii) Land measuring 02K-08M (in the name of defendant no. 2) situated at Village Bana, Hadbast No.416, Tehsil Balachaur, District SBS Nagar, Punjab vide Registered Mortgaged deed dated 30.06.2023, which is Annexure A8 to this OA. Documents executed: - Hypothecation agreements, Deed of guarantee, all dated 04.07.2023, which are Annexures A3, A6 & A7 to this OA; Legal notice dated 05.11.2024, which is Annexure A10 to this OA and Statement of accounts, which are Annexures A11 & A12 to this OA.
