In this matter, Ld. counsel for the bank submits that the property of Defendant no. 2 mentioned in Para no. 5K and while adjudicating the original application which has been described as mortgaged property. He further submits that Recovery Officer is not proceedings with the execution against this property and as advanced the bank to get the re-notification. There is no wrong, Ld. Recovery Officer can attach the property and take further steps.
In view of the above, this Misc. Application stands disposed off.
Copy of the order be given Dasti to the concerned parties. File be consigned to record, as per rules.
