This Misc. Application has been filed for restoration of MA no. 50/2023 which was dismissed for non-appearance. The reason given by the counsel for the applicant present is that his senior was not well, but no name of Advocate as such is given. There are many of the advocates who have filed Vakalatnama so if one counsel is not available other counsel could have appeared. The grievance of the Certified Debtor no. 3 who is applicant in this Misc. Application, that there is an order of NCLT where resolution plan has been sanctioned. They can file objections before the Recovery officer, if there is any grievance against such orders being passed by Recovery officer they can always come before the Tribunal.
This Misc. Application deserves to be dismissed and the same stands dismissed. File be consigned to record, as per rules. Copy of order be uploaded on website.
