Applicant Bank filed the present petition for correcting the extent of Schedule B property in the recovery certificate and corresponding amendments in the OA and final order.

According to the petitioner bank due to typographical error, the extent of the property detailed in schedule ‘B’ property to the OA 507/2018 was mentioned as 25.57 Ares instead of 15.81 Ares and therefore, the above extent mentioned in the final order of this Tribunal dated 20.09.2023 may be rectified. It is seen from the perusal of the ‘B’ schedule of the OA, the extent for the aforesaid property is mentioned as 25.57 Ares instead of 15.81 Ares. Therefore, the same extent is mentioned in the schedule ‘B’ to the final order as well as the recovery certificate DRC No.221/2023. Since the above said mistake happened due to typographical error, it is just and necessary to amend the schedule ‘B’ of the OA as well as that of the final order dated 20.09.2023 and also in the recovery certificate in DRC 221/2023 as “15.81 Ares”.

As rightly pointed out by the applicant bank, the Schedule ‘B’ was mistakenly typed in the final order. Hence Final Order and Recovery Certificate is to be corrected. It is wherefore found just and expedient to order correction of the Schedule ‘B’ in the final order and recovery certificate. Necessary corrections be carried out in the final order and an Intimation certificate be issued to the Ld. Recovery Officer to facilitate him to proceed accordingly. Memo recorded accordingly.

Accordingly, the petition, MA No.154/2025 stands allowed. The Registry is directed to carryout the aforesaid amendment in the schedule ‘B’ of the OA 507/2018 and correct the final order dated 20.09.2023 and to send an intimation certificate to the Recovery Officer.
