This petition coming on 06.10.2025 for hearing before me in the presence of Mr. Mathew Kuriakose, Advocate for the Petitioner/3^rd defendant and 1^st respondent having been set exparte and upon hearing the arguments of learned counsel for the petitioner/3^rd defendant and upon perusing the material records, this Tribunal delivered the following:

MA No.150/2025 in OA No.508/2012 :- This petition has been filed praying to accept documents produced as document Nos.R3(a) and R3(b).

MA No.151/2025 in OA No.508/2012 : This petition has been filed praying to lift the charge created in respect of 46.14 Ares of property in Sy. No.1125/1 of Madakkathara Village as per order dated 05.07.2013 in IA No.1577/2013 and communicated to the concerned SRO/VO as per order dated 16.08.2013 in IA No.3221/2012.

MA No.152/2025 in OA No.508/2012 : This petition has been filed praying to communicate the order of lifting the charge in respect of 46.14 Ares of property in Sy. No.1125/1 of Madakkathara Village to the SRO Ollukkara and Village Office Madakkathara.

MA No.153/2025 in OA No.508/2012 : This petition has been filed praying to return the original title deed No.3781/1981 of SRO Ollukkara and the Bond executed by Sh. Kuriakose, the paternal uncle of the 3^rd defendant, to 3^rd defendant or to his counsel.

It is submitted by the counsel appearing for the petitioner that a charge has been created in respect of 46.14 Ares of property in Sy. No.1125/1 of Madakkathara Village and the same has been intimated to the SRO/VO concerned and that since the petitioner discharged the entire dues

to the 1^st respondent bank and that no due certificate dated 12.04.2025 has been issued by the 1^st respondent bank, the original title deed (Sale Deed No.3781/1981 of SRO Ollukkara and the Bond executed by the petitioner’s paternal uncle Kuriakose may be returned to the petitioner.

The 1^st respondent bank filed OA for recovery of Rs.12,29,296.13 from the petitioner and the other defendants. Since there was no representation for 1^st respondent bank for further hearings, this Tribunal was constrained to dismiss the OA as no steps was taken to serve summons on the 1^st defendant.

After filing of this petition, notice was ordered to be served on the 1^st respondent bank. Accordingly, notice was served on the 1^st respondent bank, since the 1^st respondent bank failed to appear, the 1^st respondent bank was set exparte on 06.10.2025.

The petitioner has produced original ‘No Due Certificate’ dated 02.04.2025 pertaining to his loan account and copy of statement of account pertaining to his loan account. On perusal of the same shows that since there was no outstanding in the loan account of the petitioner No Due Certificate was issued to him.

In view of the forgoing reasons, these petitions i.e., MA Nos.150 to 153/2025 stands allowed as per the following lines :

(i) The Registry is directed to accept the documents produced as document Nos.R3(a) and R3(b).

(ii) The charge in respect of 46.14 Ares of property in Sy. No.1125/1 of Madakkathara Village to the SRO Ollukkara and Village Office Madakkathara is hereby lifted.

(iii) The Registry is directed to communicate the same to the concerned SRO/VO.

¶38

(iv) The Registry is further directed to return the Sale Deed No.3781/1981 of SRO Ollukkara and the Bond executed by Sh. Kuriakose, the paternal uncle of the 3^rd defendant to the counsel for the petitioner/3^rd defendant upon proper acknowledgment.
