The applicant’s counsel submits that the relief in terms of prayer clause 8 (a) (i) and (ii) are complied by the bank. The secured creditor issued no dues certificate and the loan account is closed. The learned counsel submits that the relief in terms of prayer clause 8 (a) (iii) does not fall within the purview of the measures under the SARFAESI Act and will approach the secured creditor. The learned counsel therefore, requests the Tribunal to dispose of the Securitisation Application.
