an extent of 1300 sq. ft., including the common area and balcony, together with undivided share of land admeasuring 20 sq. yds., out of the total extent of 169 sq. yds., bearing GWMC H.No.9_ 10_64 (part), situated at Durgeshwara Swamy Temple Street, Girmajipet, Warangal District (schedule property), vide Sale Deed bearing Doc.No.21599 of 2022, dt.25.O8.2O22, from the 2"d Respondent, and she is in peaceful possession of the said property with her family. Before purchasing the said property, the Applicant enquired with the Registration Department and found no encumbrances over the said property. While so, the lst Respondent Bank issued possession Notice dt.O1. 12.2022, claiming an amount of Rs.42,S 1,Sg3 in respect of the subject property. The 2,a Respondent has never disclosed about the roan transaction with the r"t Respondent Bank. challenging the action of the lst Respondent Bank, the Applicant approached the Honble High court for the state of Telangana at Hyderabad vide Wp.No.45432 ot 2022, wherein the Hon',ble High court granted liberty to the Applicant herein to avail remedy provided u/s. 17 of the SARFAESI Act, before this Tribunal. In the meanwhile, the l"t Respondent Bank has proceeded to take physical possession of the schedule propert5r through Advocate Commissioner,s vacate notice dt. 13.10'2023 issued in crl.M.p.No. 17 0f 2023 0n the file of Ld. CJM, Warangal. During pendency of the present SA, the Applicant filed IA.No.273r2023 seeking redelivery of possession of the schedule property contending that, even after compliance of the conditional orders of stay granted by this Tribunal vide order dt.2O.1O.2O23 in IA.No.244gl2O23, the lst Respondent Bank has highhandedly taken physical possession of the schedule property through Advocate Commissioner on 19. 1 I .2025 in pursuance of the aforesaid Advocate commissioner's vacate notice dt. 13.10.2023, issued in Crl.M.P.No.lZ of 2023.
