Learned counsel for the respondent bank appears and submits that the previous SA was disposed of as infructuous by order dated 16.6.2023. Learned counsel further submits that on the same cause of action, the applicant has filed this SA challenging sale notice dated 19.10.2023 and publication of sale notice dated 19.10.2023.

Learned counsel for the respondent bank submits that no sale took place on the sale notice dated 19.10.2023. Hence the sale notice dated 19.10.2023 which was scheduled to be held on 23.11.2023 becomes infructuous.

The sarfaesi applicant is not present.
