Rs.32,42,000/- to Rs.29,17,800/- without any reasonable cause and basis and there is no further valuation made on 06.05.2022 as per Annexure-R/5, Page-59 to 74 of the counter affidavit. Though the actual valuation of the secured property pledged to the Bank would be more than Rs.60,00,000/-, the authorized officer having hand in gloves with the so called auction purchaser, the defendant No.3 made an unholy alliance to complete the auction sale contrary to law instead of following Section 13(8) of the SARFAESI Act. When the market value of the property is more than Rs.60 Lakhs, the property sold at a meager price which itself indicates the personal vested interest of the Defendant No.2 which is contrary to the object, purpose & legislative enactment of the SARFAES Act, 2002 and rules framed there under. The statement regarding after declaration of Housing Loan Account No. 05790610008584, the unpaid interest from date of NPA to August, 2022 was charged for which the outstanding amount is Rs.7,27,616.67/- as on 23.09.2022 and the other Housing Loan Account No. 05790610014684, the unpaid interest was also charged for which an amount of Rs.4,67,600/- is miscalculation rather the account statement i.e. Annexure-R/4 Series itself indicates that on 23.09.2022 which includes both normal & penal interest which is contrary to law laid down by the Hon’ble Apex Court and RBI Guidelines since no Penal interest is chargeable after declaration of Housing Loan Account as NPA. Further the handwritten statement at Page-47 under Annexure-R/4 Series indicates that as on 09.02.2023, the outstanding balance was Rs.7,50,429.08/- which has no rational basis & calculation which includes several penal interest and normal penal interest, all are credited in the particular date i.e. on 23.09.2022. similarly assuming for sake of arguments though not admitted if at all the outstanding balance as on 09.02.2023 of Rs.7,50,429.08/- the same might have been including the normal interest component but the further imposition amount for self same period from September, 2022 to February, 2023 for Rs.43,276.65/- and in heading of “Sale of Assets under SARFAESI Act through efforts of RA where reliable value of Security available” for Rs.90,000/- and the Advocate fee of Rs.26,500/- and conducting sale through e-auction of Rs.30,000/- arbitrarily and unreasonable in the outstanding dues and the same would have been excluded leaving the balance outstanding as on 09.02.2023 at Rs.7,50,429.08/-, thereby the demand of Rs.9,40,000/- is without any basis.
