Jammu and Kashmir had sanctioned some credit facilities to the applicant. Since, applicant could not make the payment of the loan, the Bank initiated the SARFAESI proceedings. Earlier, applicant had also filed SA No.35 of 2023 (it appears that the date of order has been wrongly mentioned as 24.03.2022 instead of 24.03.2023), which was dismissed by this Tribunal, vide order dated 24.03.2023. Thereafter, bank issued the sale notice. Applicant has challenged the sale notice in the present SA. However, the e-auction did not materialize.
In view of this, there is nothing to adjudicate in this SA. Accordingly, the present SA stands disposed of . File be consigned to record room after due compliance.
