the floors in favor of Applicant Nos.2 and 3. HSVP also allowed the sellers to sell the floors. Accordingly, Applicant Nos.2 and 3 purchased the ground and first floor from Sh. Sandeep Sanduja and Smt. Kiran Sachdeva and second floor from Smt. Raj Bala. On 27.11.2018, HSVP also transferred the ownership in favor of Applicant Nos.2 and 3. In the year 2023, Applicant Nos.2 and 3 decided to transfer this property in favor of Applicant No.1. Vide transfer-deed dated 07.04.2023, the whole of the property was transferred in favor of Applicant No.1. It is alleged that at no point of time, it was brought to the notice of the Applicants that the property was under mortgage in favor of Union Bank. Applicant Nos.2 and 3 claim that they are bona fide purchasers and the Bank cannot enforce its security interest against them. It is also alleged that FIR No.649 dated 09.10.2023 under Sections 406, 420, 120-B of IPC was registered at Police Station, Gurgaon Sadar, Gurugram, against the earlier owners as well as the Chief Manager of the Respondent Bank, Moti Bagh, Palika Bhawan, RK Puram, New Delhi. On these facts, Applicants prayed that the SARFAESI action taken by the Bank be set-aside.
