Lacs vide Application Form dated 16.03.2015, which is Annexure A2 to this OA. Defendant No.2 stood as guarantor. 3. The applicant Bank sanctioned the KCC Limit of Rs.15.00 Lacs vide Credit Sanction Intimation, which is Annexure A3 to this OA and the terms and conditions were duly accepted by the defendants. 4. Defendant No.1 had mortgaged his immovable property i.e. land measuring 32 Kanal 00 Marla situated at Village Birviawali, Tehsil and District Muktsar, Punjab vide Mortgage deeds dated 16.03.2015 and Letter to Sub-Registrar for creation of charge bearing vasika no.1091 and Declaration u/s 4(1) both dated 27.02.2015 and Jamabandi for the year 2012-13 with its translation , which are Annexures A6, A7, A9 and A10 to this OA. Documents executed:- Hypothecation agreement, Letter of undertaking and Deed of guarantee all dated 16.03.2015, which are Annexures A4, A5 and A8 to this OA; Legal notice dated 23.01.2023 along with postal receipts, which is Annexure A11 to this OA and Statement of account along with Certificate, which is Annexure A12 to this OA. 5. The loan account became irregular and was classified as NPA and after adjusting debit and credit entries in loan account there was a debit of Rs.23,43,882.00, which is recoverable and the defendants were served recall notices but they did not repay the outstanding amount, therefore, the applicant bank requested to accept the application and to issue Recovery Certificate accordingly. 6. The defendants were served notices to appear before this Tribunal but no one appeared on behalf of defendants and they were proceeded ex-parte on 15.05.2024. 7. In support of the OA, affidavit of Sh. Vinod Kumar, Branch Manager, Union Bank of India has been filed. 8. Heard ex parte arguments and perused record. 9.
