The^point that arises^{for considerationis :}

whether the Applicant Bank^{is entitled to the claim made in the OA againstthe Defendants} and OA schedule^{properties as prayed for?}

As stated supra, the^{Defendant remained absentand did not turn up to controvert the} version of the o.A. of^{Applicant Bank.The EvidenceAffidavitcoupled with the recitals in the} documents viz., Exhibits^{Annexure-Ato Annexure-A/2s marked on behalf of theApplicant} Bank, established the claim^{of the Applicant Bank againsttheDefendantsand oA schedule} propedies. Hence, I hold that the Defendants^{are jointlyand severally liable to payto the} Applicant Bank the claims^{made in the OA with futureinterest and costs'}

In the result, the^{present Original Applicataonis allowed ex-parte with costs,as under:-}

ORDER

O.A, No. 565 of 2022 filed^{by the ApplicantBank is allowed and debtis determinedwith cost} against the defendants.^{It is hereby orderedthat applicant bank is entitledto recoverfrom} the defendants the^{total amount to the tune of Rs.30,27,987.76l-(Rupeesthirty lakh} twenty seven thousand^{nine hundredeighty sevenand paise seventysix only)with} pendentelite and future interest @ 9.600/0^{per annuminterest with simple on the amount} due from the date of filing^{of the originalApplicationi.e. 30/09/2022till full andfinal} realization of the claim amount.

(2) Amount, if any,^paid by the^{defendantsin the loanaccountsor amount, if any, recovercdby} the Applicant Bank^{after filing of theO,A. the same be taken intoaccountwhile arrivingat} the exact amount of dues/debt^{payableby the defendants.Accordingly,pendenteliteand} future interest shall be calculated^{on the reducedamount.}

(3) Defendants are debarred^{fromdisposing, alienatingor dealingwith anyof theproperties} belonging to them^{till the aforesaid decretaldebt is recovered from the defendants'}

(4) Defendants are^{given a time of thirtydays from the date of the Judgement/Final Orderfor} repaying of the above^{mentioned dues, so intimated to them ln casethe defendantsfail to} pay the dues within the above mentioned^{time, the applicant bank is entitledto recoverits} dues by sale of secured^{assets, if any. Applicant bank is also entitled to proceed against} personal properties of the defendants^{(Bothmovableand immovable)and also proceed} against the defendants^{personallyto recover the dues in accordancewith law'}

(s) Let the Certificate of^{Recoverybe drawn up by Ld Registrar forthwith in termsof} ludgement for issuance^{of thesame against defendantsin favour of theapplicantbank} under Section 19^{(22) of the Recoveryof Debts andBankruptcyAct,1993and put up the} same for issuance of the^Certificate.

(6) Ld. Recovery Officer shall realize^{the amount as per the Recovery Certificatefromthe} defendants in accordance^{with law.}

(7) Ld, Registrar of this Tribunal^{is directed to deliver recovery certificate in termof thefinal} order/judgement for^{recovery of the sum against the defendantin favourof theApplicant} Bank under Section^{19 (22) of the Recovery of Debtsdue to the Bank and Financial} lnstitutions Act, 1993^{now knownas Recoveryof Debtsand BankruptcyAct, 1993'}

(8) The parties are directed to appear^{before the RecoveryOtficer on 9/O4/2O24for further} actioninaccordancewithlawintheeventtheentireamountisnotpaidbythesaiddate,
