By this Interlocutory Application No.859/2024 the learned counsel appearing for the applicant-bank seeks permission of this Tribunal to withdraw the Original Application submitting that the defendant has paid certain amount in their loan account and they have regularised their loan account and as such the applicant bank do not want to proceed further. He requests for withdrawal of the matter with liberty to file fresh OA in case the defendant makes any default in future in repayment of the loan facility availed by him. 2. The counsel requests for return of the original documents and also refund of the court fees as per rules. 3. In view of the above statement made by the counsel for the applicant-bank, I pass the following order. ORDER A. The Interlocutory Application No.859/2024 stands allowed.
