application dated 23.01.2023, which is Annexure A4 to this OA and the terms and conditions were duly accepted by the defendants. 4. Defendant no.1 had hypothecated his Vehicles detailed as:(i) Bharat benz 5428TT+ 4X2 BSVI:- Registration No.PB13BQ8272, Engine No.926956D0137790 and Chassis No.MEC862FCMNP131100 (ii) Bharat Benz 5428TT+ 4X2 BSVI:- Registration No.PB13BQ6472, Engine No. 926956D0136246 and Chassis No. MEC862FCLNP129712 vide FOP’s, which are Annexures A7 & A8 to this OA. Documents executed:-Deed of Hypothecation, Irrevocable Power of Attorney both dated 23.01.2023 which are Annexures A5 & A6 to this OA; and Statement of Accounts & foreclosure statements along with the Certificate regarding the Computer System, which are Annexures A9 to A16 to this OA and Notice dated 20.02.2024 along with Postal receipts, which are Annexures A17 to A19 to this OA. 5. The loan accounts became irregular and were classified as NPA and after adjusting debit and credit entries in all loan accounts there was a debit of Rs.87,71,920.00, which is recoverable and the defendants were served recall notices but they did not repay the outstanding amount, therefore, the applicant requested to accept the application and to issue Recovery Certificate accordingly. 6. The defendants were served notices to appear before this Tribunal. Sh. Karan Bhardwaj, Advocate appeared through video conferencing on behalf of defendants on 07.06.2024 but did not filed his Power of Attorney. Since no one appeared on behalf of defendants and they were proceeded ex-parte on 07.09.2024. 7. In support of the OA, affidavit of Sh. Md. Vajid, Manager, ICICI Bank Ltd. h as been filed. 8. Heard arguments and perused record. 9. It was argued by learned counsel that in view of the documentary evidence brought on record which had gone unrebutted, the applicant had proved its case.
