2' As per the averments in the apprication, the Appricant Bank states that defendant No.1 is a partnership firm represented by defendants 2 & 3 as partners/ guarantors availed term loan of Rs.150 lakhs. The defendants 2 & 3 hypothecated a, the movabre assets more fury described in schedure to oA. The defendants arso avaired GECL roan of Rs'26'00 rakhs as working capitar term roan on 1g.11.2020 and executed various necessary documents. After avairing the roan facirities, the defendants faired to compry the terms of sanction, hence the applicant bank was constrained to classify the account as NPA and issued legal notice dated 28.1L.2022. Inspite of several requests and demands, the defendants did not crear the outstanding. Hence this OA.
