(ii) total land measuring 24K-07M situated at Village Kanganpura, Tehsil Malout, District Sri Muktsar Sahib, Punjab; owned by defendant nos.1, 2 and 4; and (iii) total land measuring 30K-06M situated at Village Mehmud Khera, Tehsil Malout, District Sri Muktsar Sahib, Punjab; owned by defendant no.3; Vide Declarations u/s 4(1) of the Punjab Agricultural Credit Operations & Miscellaneous Provisions (Banks) Act, 1978 dated 24.01.2020 and 27.01.2020, which are Annexures A9 & A10 to this OA. Documents executed: - Loan-cum-Hypothecation Agreement, D.P. Notes, D.P. Note Delivery-cum-Waiver Letters all dated 22.01.2020, which are Annexures A4 to A8 to this OA; Legal Notice dated 16.04.2022 along with Postal Receipts, which is Annexure A11 to this OA and Statements of Accounts, which are Annexures A12 to A14 to this OA. 5. The loan accounts became irregular and were classified as NPA and after adjusting debit and credit entries in loan accounts there was a debit of Rs.24,62,089.10p, which is recoverable and the defendants were served recall notices but they did not repay the outstanding amount, therefore, the applicant bank requested to accept the application and to issue Recovery Certificate accordingly. 6. The defendants were served notices to appear before this Tribunal but no one appeared on behalf of defendants and they were proceeded ex-parte on 17.01.2024. 7. In support of the OA, affidavit of Sh. Rohit Varun Singh Thakur, Deputy Manager, Axis Bank Ltd. h as been filed. 8. Heard ex-parte arguments and perused record. 9.
