The Ld. Counsel appearing for the Appellant contended that the Appellant, is an agriculturist and secured a loan of Rs. 10,50,000/(Rupees Ten Lakhs Fifty Thousand Only) from the 1st Respondent Bank on 12th September 2009 to support his agricultural endeavors. However, circumstances took a turn, leading to a debt amounting to Rs. 14,37,508/-(Rupees Fourteen Lakhs Thirty Seven Thousand Five Hundred and Eight only). In response, the bank initiated legal proceedings by filing an OA for a sum of Rs. 14,37,508/- before this Hon'ble Tribunal, seeking the recovery of the balance outstanding sum. Following the legal proceedings, a Final Order was issued on 6th July 2018, and subsequently, a DRC was issued on 27th July 2018 by the Debts Recovery Tribunal, Madurai. However, an unfortunate error occurred in the process when the Registrar of DRT, Madurai, acting beyond his jurisdiction, sent the decree passed by the DRT, Madurai to the DRT –III, Chennai. Whereas, the property is situated within Trichy District, falling under the territorial jurisdiction of DRT, Madurai. Therefore, the entire jurisdiction for execution lies solely within the boundaries of DRT, Madurai. Then, the Recovery Officer of DRT-III, Chennai, on 6th September 2021, issued an order of attachment (Page No. 22 of Typed set pages) and sent letter to Uppiliapuram Sub Registrar, Trichy District (Page No. 24 of Typed set pages). In the meanwhile, the 1st Respondent Bank granted OTS vide letter dated 13.01.2022 to pay Rs. 10,34,632/- plus interest on 31.03.2022
