The respondent bank took possessionof the secured assetson 29.11.2021 vide possessionnotice issued u/s 13(4) of the act but the possessionnotice neither served upon the applicant nor been published in two leading newspapers. The possession notice was also not affixed on the secured assets. The applicant has been regularly repaying the loan and in process repaid the entire dues of the bank by 10.02.2022 leaving behind a nominal amount of Rs.1/-. Further, the applicant approached the bank for calculation of interest if any for liquidation of entire dues but the bank official refused to do so and stated that your property will be auctioned. Further, the applicant sent a blank cheque alongwith letter dated 16.02.2022 to the bank for liquidation of dues if any. The said letter alongwith blank cheque was delivered to the bank on 17.02.2022 as per its tracking report but without liquidating the amount, proceed further with ulterior motive and put the property on auction by publishing the sale notice dated 30.01.2022 fixing the date of e-auction on 09.03.2022. Since, the applicant has liquidated total dues and also given blank cheque to fill it up with interest part, if any, therefore, the S. action of the bank may be set aside and respondent bank may be directed to issue No Dues Certificate in favor of applicant and return the title deed deposited with the bank assecurity.
