Present: Sh. Musroor Mushtaq, Counsel for the Applicant. Sh.Rahul Garg, Counsel for respondent bank alongwith Sh.Sandeep Kumar, Authorized Representative of the bank.
File taken up today on IA No.365/2023 and IA No.366/2023 filed by counsel for the applicant.
Counsel for the applicant has made a statement at the bar that applicant is ready to regularize his account and applicant would pay Rs.5 lacs within 15 days and another sum of Rs.5 lacs within another 15 days. He further states that he would deposit the remaining overdue amount within one month of the second installment and would regularize his account.
Subject to his fulfilling the undertaking, bank is restrained from taking the possession. However, bank would be free to take any action in case of any default in making the payment.
Counsel for the applicant states that in view of the statement made above, he does not want to pursue the present SA. Accordingly, the application is hereby dismissed as
withdrawn .
