is the case of respondent bank that applicant had approached respondent bank and availed Loan against property for a sum of Rs.10 Lakhs on 07.02.2018. It is submitted that applicant committed default in repaying his dues and despite repeated requests, as applicant did not come forward to repay the dues, respondent had classified the loan account as NPA on 02.12.2021 and issued Demand Notice under Section 13(2) of SARFAESI Act dated 22.01.2022. It is further submitted that since respondent did not receive neither the returned cover nor the acknowledgement cards, had published the demand notice in two leading newspapers (The New Indian Express & Dinamani) on 03.03.2022. As applicant did not come forward to clear the dues even after expiry of statutory period, respondent issued Possession Notice dated 06.05.2022 which was returned with postal endorsement “No such person”. Respondent bank had affixed the said possession notice in the conspicuous place of the secured asset and published in two leading newspapers (The New Indian Express & Dinamani) as warranted under law. Subsequently, respondent bank had filed a petition under Section 14 of SARFAESI Act and obtained orders from Ld.CJM, Chengalpatu vide Crl.M.P.No.7997/2022 dated 25.08.2022. Ld. Counsel for respondent submitted that there are no infirmities in the procedure adopted by the respondent while initiating measures under the Act and prayed for passing necessary orders.
