Respondent bank has issued demand, possession and sale notice against the dead person and now has issued the sale certificate dated 27.03.2023, which is illegat and against to the principles of natural justice. The Appellants have submited that the Appellants are into the business of transport of Iron Ore and the Appellant No.1, being the borrower and the Appellant No.2 is Co-Applicant have availed the credit facilities from the Respondent Bank. After availing the loans, the Appellants have repaid few installments and due to medical treatments the Appellants could not repay the amount, though the Appellant No.2 was also conducting business along with his father, the Appellant No.1 and owns an Itachi Pockeline vehicle, which was used for excavation of iron ore. The Appellants have filed an appeal against the possession notice issued by the Respondent Bank and further filed an IA in SA No.169/2022. The Appellants states that, both the Respondents have colluded on each and sold the property for a sum of Rs.94,10,000/- to Respondent No.2 illega y, fraudulently created the sale certificate dated 27.03.2023. The Respondent Bank has mentioned in the sale certificate that the possession of the sold schedule property has already handed over to the Respondent No.2, but the Appellants claims that the Appellants and their family members are
