some of the shops without the permission of the respondent bank and also failed to deposit such sale proceeds. Accordingly, the loan account has been classified as NpA and issued demand notice dated 06.04.2 022. ln response, applicant vide letter dated 16.05 .2022 offered to clear the dues in instalments. However, applicant failed to keep its promise. Thereafter, respondent issued possession notice dated 11.07.2022. At the request of the applicant, publication of possession notice dated Lt.07.2022 was withheld on the premise that applicant would clear the dues. As the applicant failed to keep its word, respondent proceeded with publication of possession notice in Hindu, English Daily and Sakshi, Telugu Daily on 14.07.2022 Both the possession notices have been duly sent to the applicant under registered post, but the same were returned unserved. Applicant had not kept its word to close the loan account by 16.12.2022 as promised vide letter dated 17.11.2022. Applicant has not raised any objections to the demand notice u/s 13(2). Instead appricant offered to crear the dues in instalments vide its alleged letters. Hence the said representations cannot be construed as objections the demand notice u/s 13(3). The applicant cannot challenge the warrants in two Cr.M.ps in one SA. With these submissions, respondent bank prayed for dismissal of the SA.
