Ld counsel Ms. Rakhi Mondal for Mr. Shankar Singh appears for the applicant bank. Applicant has moved the I.A. 323 of 2023 by put petition being I.A. 322 of 2023 praying for withdrawal of the main O.A. and also seeks for refund of the Tribunal fees. The I.A. is supported by an affidavit affirmed by Mr. Swapan Kumar Mondal, Manager of the applicant bank. No due certificate is also annexed to the instant I.A. Ld counsel for the applicant submits that during the pendency of the O.A. One Time settlement has been arrived at between the parties at Rs.57 lakhs and entire amount was deposited by the defendant and applicant bank is not going to continue the instant proceeding. Since this is an amicable settlement between the parties and applicant bank intends to withdraw the main O.A., no prejudice will be caused if the I.A. is allowed without inviting response from other side. Accordingly instant I.As. are allowed and stands disposed of in the category of dismissed as withdrawn as amicably settled. So far the refund of Tribunal fees is concerned, the applicant may move before the Ld Registrar of this Tribunal who may take decision in accordance with the rules and regulations on the subject. |
