Defendants or their agents from alienating, transferring oi' disposing of the Schedule-C property (Apartment No.306) mentioned in the main application to any other third party, pending disposal of the present application, in the interest of justice and equity. In the affidavit, inter alia, it is submitted that Defendants No.1 and 2 availed a loan of Rs.27,02,760/from the Applicant Bank in the year 2016 for the purpose of purchasing the immovable residential property after executing various relevant loan documents, agreement, deed, etc, repayable in 250 equated monthly instalments. The Defendants after perfunctory payment, failed to pay the outstanding dues to the Applicant Bank despite several reminders. It is further submitted that except the schedule properties, the Applicant Bank has got no other source to recover the due amounts from the Defendants and they are trying to dispose of the saidproperties so as to defraud and disclaim the genuine claim of the Applicant Bank. The Applicant Bank apprehends if the Defendants succeed in their attempt, the Applicant Bank will be put to irreparable loss, damage and injury. Hence, the Applicant Bank has sought to allow the present I.A. as prayed for, in the interest of justice and equity.
