The present OA is filed by the Applicant Bank against the Defendants for issuance of recovery certificate and other reliefs for recovery of a total sum of Rs.37,87,673/- together with further applicable rates of interest thereon, costs, charges etc.

The above Interlocutory Application is filed by the Applicant Bank with affidavit of its Branch Manager, Mr Mahamad Ali Muddebihal, seeking to pass an order of temporary injunction, restraining the Defendants or any person claiming under the Defendants, their agents, attorney holders or any persons from transferring, alienating or otherwise deal with or dispose of the schedule property till disposal of the main petition, in the interest of justice and equity. In the affidavit, inter alia, it is submitted that the Defendant No.1 after availing various agricultural loan facilities from the Applicant Bank on execution of various loan documents, simple mortgage deeds, etc., has clandestinely gifted/partitioned to Defendants No.3 to 11 certain extent of the property mortgaged to the Applicant Bank. The Defendants in spite of being issued with several notices by the Applicant Bank did not give heed nor have they remitted any amount or closed the loan accounts. It is further submitted

that the Defendants^{are trying to alienate the schedule} property to a third^{party and the Applicant Bank apprehends} that if the Defendants^{succeedin their attempt, the Applicant} Bank will sustain^{irreparable loss, damageand injury' Hence,} the Applicant Bank^{has sought to allow the I'A'No'578/2023} as^prayed for till^{disposal of the main application'}

It appears that^{the Petitioner/ApplicantBank has filed} the above I.A.^{on the premisethat Defendants may alienate} or dispose of in^{any way creating third-party interest on the} mortgaged schedule^{property morefully described in the} schedule. Considering^{the huge amount of O'A' involved in} this case, and^{balance of convenience, the present IA is to be} allowed by keeping^{open the merits of the caseand without} prejudice to the rights of^{both the parties'By doingso, no} prejudice, no harm and^{no loss will be causedto the} Defendants. As^{the ApplicantBank has primafacie} established the^{essential ingredients for granting ex parte} ad interim order^{of injunction,I proceedto pass following:}
