| 19/10/2023 | The Applicant Bank has filed withdrawal petition, bearing application no. IA/2036/2023. In the above said application it was stated that the Applicant has filed a Recovery application for recovery of a sum of Rs.22,13,675.00/- including interest and other reliefs. During pendency of the Recovery Proceedings, the collateral security which was mortgaged to the Bank was sold to the Third Party Purchaser in consideration of Rs. 29,53,000/- and the Sale Certificate dated 20.06.2023 was issued by the Applicant Bank, copy of which is annexed herewith. The Bank has adjusted Rs.22,13,675.00/- to the Defendant’s Loan Account towards full and final settlement of the dues. Hence, they do not want to proceed with the case. This application is affirmed by Mr. Satyajit Chowdhury, the Chief Manager of the Bank and his signature is identified by Advocate on record. In view of this, no prejudice will be caused to the OA defendants if their response is dispensed with in this IA. This instant OA and any other pending IAs are disposed of in the category of dismissed as withdrawn as settled. |
