After filing of the OA the Tribunal issued noticesuponthe defendants through registeredpost and the applicant bankfiled servicereport on 20.05.2022 and brought on record thepostal receipts along with trackconsignment report.The learned counsel for defendants No I & 2 hasappeared by filing vakalatnama on 27.05.2022 and sought time for filingwritten statement cumevidence on affidavit. On 02.09.2022 defendants No 1 & 2 hasfiled their written statementandevidenceon affdavitto which learned counsel for the applicantfiled rejoinderon 15.09.2022.lt is observed that learned counsel for the applicant bankhas filed an l.A. No.24812022 withthe prayer to allow ihe substitution ofthe namesof the legal heirsof the deceased defendant No.3 Late RamU Uddin Mazumder.Accordingly, afterhearingthe parties, the said l.A. No. 24812022 was allowed andpermittedthelearned counselfor theapplicant bank to bring on record the legalheirs of thedeceaseddefendanl No. 3 i.e. defendantNo. 3(a), 3(b),3(c),3(d), 3(e), 3(1)& 3(g) with red ink, and also permitted the learned counsel for the applicant bankto issue noticesto the legal heirsof the defendant No. 3 i.e. defendant No. 3(a). 3(c),3(d),3(e), 3(1) & 3(g) after substitutingthe cause title in the OA. lt is also observedthat the defendant No 3(b) is alreadyon recordas defendant No.2 and learned counselSri C Kalita has appearedfor defendantNo 2. Registry was directed to issuenoticesto the defendant No. 3(a),3(c)'3(d), 3(e), 3(0 & 3(g) after substituting the causetitle in the OA by the learned counsel for the applicant bank. On 22.07.2022, learnedcounsel for the applicant bank fled servicereport and brought on record thepostalreceiptsalong with track consignment report. lt was observed lrom the track consignmentreport that the nolices have not beenserved upon the defendants No 3(a), 3(c),3(d), 3(e), 3(f), & 3(g).
