| 30/08/2023 | Ld. Advocate Ms. A. Pramanik appears for the Applicant Bank and pressing the withdrawal petition being no. IA/1652/2023. In the above said application it was stated that the Applicant has filed a Recovery application for recovery of a sum of Rs.1,28,21,09,967.00/- including interest and other reliefs. During pendency of the Recovery Proceedings the defendants had approached the Bank and paid entire dues. Hence they do not proceed the case and prays for withdrawal of this matter with a liberty to file application as and when occasion arise in respect of the Bank Guarantee, Letter of Credit or any other liabilities which has not been invoked as there is another account which is yet to close. This application is affirmed by Mr. Dilip Kumar Turi, the Chief Manager of the Bank and his signature is identified by Advocate on record. Ld. Advocate for the Applicant Bank also prays for refund of application fee. In view of this, no prejudice will be caused to the OA defendants if their response is dispensed with in this IA. This instant OA and any other pending IAs are disposed of in the category of dismissed as withdrawn as settled with liberty to file proper application u/s 19 of the RDDBFI Act as and when the situation arises.
