CC Limit of Rs.95 Lacs to defendant Nos.1and 2 for business purpose. Defendant Nos.1 and 2 had executed all the documents (fully detailed in para No.4 of the OA). Defendant Nos.3 and 4 had stood surety and executed the guarantee letter dated on 24.01.2014. Vide sanction letter dated 01.06.2016, (Annexure A-15), the limit was enhanced from Rs.95 Lacs to Rs.120 Lacs. Defendant No.1 and 2 executed all the relevant documents (fully detailed in para No.8 of the OA). Defendant Nos.3 and 4 executed the guarantee letter on 01.06.2016. Defendant Nos.2 and 4 also created mortgage of the property (fully detailed in para No.11 of the OA). The said property was already under mortgage in the case of loan by M/s Hanu Traders. Defendant No.2 also created mortgage of the property (fully detailed in para No.12 of the OA) which was already under mortgage by M/s Hanu Traders. Similarly, defendant No.2 created mortgage of the property (fully detailed in para No.13 of the OA) which was already under mortgage by M/s Hanu Traders. On 26.09.2017, the limit was renewed and defendants executed the documents (fully detailed in para No.14 of the OA). On 20.12.2018, the limit was again renewed and the defendants executed the relevant documents on 20.12.2018, the documents are (fully detailed in para No.15 of the OA). Thereafter, the limit was again renewed on 04.11.2020 and the defendants executed the documents (fully detailed in para No.16 of the OA). The bank also granted Covid Funded Interest Term Loan amount into Rs.11,35,001/-. At the time of filing the OA, Rs.1,52,13,385.98p was due. On these facts bank filed the present OA. Despite repeated requests, defendants did not make the repayment. Hence, this application.
