This is an application under section .19 of the Recovery of Oebts Due to Banks and Financial lnstitutions Act. 1993 liled by the U Co Bank, ltanagar Branch, TT Marg, Bank Tinali, ltanagar, Arunachal pradesh 79111'l, with a prayer to issue Recovery Certificate for the sum of Rs. 2,SO,BO,279.OZ (Rupe$ Two Crore Fifty Lacs Eighty Thousand Two Hundred Seventy Nine and paisa Ssven) only as on 10.02.2022 against the defendants with pendentetite and future interest @7.3% per annum w.e.f.^,1.1.02.2022 lill .€alization along with cost and other reliei

A few facts giving rise to the present application are as under

The defendant No. 'r, is a proprietary concern and defendant no. 2 is the proprietor of the defendant no. 1 who is a businesswoman and is a cuslomer of the applicant bank. Defendant No.3 is the guarantor of the defendant No.1. It is stated that initially a term loan was availed in the name of partnership firm, represented by its two partners. subsequenfly, lhe aforesaid partnership firm was dissorved on 23-03-2007 vide Deed of Dissolution of partnership being no. ITA/A./162-07.

The defendant No. 2, vide toan application dated OS-04- 2003 approached before the applicant bank, seeking financial assistances for the purpose of her business and in support of her loan proposal, the defendant No. 2, also submifted all necessary papers and olher documents etc. which were examined by the applicanl bank. Further, on being satisfied with all the necessary documents, the applicant bank on 27-12-2003 was pleased to sanction a term loan of Rs. 111.00 lacsl^(Rupees One Hundred Eleven Lacs) only in favour of the defendants against the prime security of land^{and building (2200 sq meter of land standingin the name} of Mrs. Toko^{Yaram allotted vide allotmentorderDLM-LR-4/98,15dated} 17-07-2003^{by Govt. of Arunachal Pradesh)plant & machineries,furniture and} fixtures^{and other movable and immovableassets/property and collateralsecurity} of FDR^{amountof Rs. 25,00,0001etc'}

The applicant bank initially sanctioned the aforesaid ierm loan of Rs.111.00 lacs vide Zo ref: RMJ/CAO/LS/2003-04 dated 27-12_ZOO3 and subsequenfly a cash credit of Rs.So tacs vide Ref: ZOJI CADI LS/ 83/2005-06 dared 21_02-2006 was sanctioned to the defendants. The defendants in consideration of granting and sanctioning of Cash credii of Rs.50.00 lacs executed the following documents in favour of the applicant Bank:

Again upon request being made by the defendant no.2 on behalf of defendant no.1 lhe said short term cash credit limit was subsequenfly enhanced/renewed from Rs. 1OO lacs to Rs.144 lacs by the applicant bank vide its sanction letter dated.08-03_20.13 against the security hypothecation of stock of potato, at 167^0/o of drawal amount at every point of drawal, already stored in the Cold storage situated at Banderdewa & plant & machinery. The loan is to be collaterally secured by extension of registered mortgage of landed property measuring 2200 sqmt. covt allotment no.OLM_ LR*4/98r/1 g dated..t 7_07_2003 situated at Banderdewa, papumpare, A.p standing in the name of Smt. Toko Yaram, value at Rs.3O3.1O lacs as per valuation report dated. i4-03_ 2013 by Mr. J.C Sharma, empanelled valuer and extension of registered mortgage of land of Sri Toko Tallo at cumto viflage, Doimukh alotted vide retter no. Dc/LM/Lpc-l so/os dated 20-06-2007 valued Rs.42.31 lacs as per valuation report dated. .t4_03_2013 from Mr. J C Sharma, empanelled valuer and exlension of lien of CFD for Rs..lO lacs. And, the loan is personally guaranteed by Mr. Toko Tallo, spouse of the proprietor. And the margin 40% on owned stock and interest 10% pa with half yearly rest and the defendants also executed vadous documents in favour of the applicant bank to secure the above limit.

The defendants in consideration of granting and sanctioning of CC limit of Rs.144 Lacs and renewat of CC Limit of Rs.sO Lacs, total timit to Rs.194 Lacs, executed the following documents in favour of the applicant Bank: a) Deed of hypothecation of Goods to secure a demand cash credit of Rs.1,44,00,000/- dated 08-03- 2Oi 3; b) (A_1) Demand promissory note of

The applicant bank on 06-09-2020 during Covid-1g pandemic both the abovementioned CC accounts interest were converted to FITL accounts (Funded lnterest Term Loan accounts) being account no. 14g20610005927 and account no. 1 482061 000591 0 respectivety.

The defendant no.2 vide its letter requested the applicant bank for substitution of repracing the property standing in the name of roko Ta[o, the defendant no.3 by another property standing in the name of defendant no.3,Toko Tallo. Accordingry, the appricant bank vide its retter dated. 06-02- 2017 requested the Deputy Commissioner, ltanagar, Arunachal pradesh for substilution of property of defendant no. 3 and creation of new registered mortgage in the name of defendant no.3. Accordingly, the sub-registrar, Office of the Oeputy Commissioner, Itanagar capital complex was pleased to cancelled lhe mortgaged deed registered vide 90 dated. i 3-04-2011 and vide Land possession certificate no. DC/LM/LPC'150/05 dated 20-06-2007.

As a security for the repayment of the aforesaid loan facility availed by the defendants, the defendants crealed mortgage with respect to their plots of land and building (more specifica[y described in schedure of the oA) owned and possessed by the defendant no.2 & 3 by depositing the tifle deed in original in respect to the said properties along with other relevant documents in favour of the appticant bank.

The Defendants had availed of the said loan facilities from the Applicant Bank, but have not paid the loan amount as per the terms and conditions as agreed upon with the Applicant Bank, inspite of repeated demands and requests by the Appticant Bank.

As the defendants failed and/or^neglected lo^{operatethe loan accountsproperly,} followed by non- depositing of the^{outstanding duesand overdue amounts in time,} in-spite of repeated reminders issued by the^{applicant bankand also on personal} approaches made by the applicant^{bankfrom timeto time, the said accounlsbecame} NPA on 31-03-2021. However, the^{defendants executed Acknowledgement of Debt} And security dated 10-03-2010,^{23-06-2010, 01-02-2016, 21-01-2015and 26-08-} 2021 for account no.^{'14820500008776and 28-03-2012, 01-02-2016,21-01-2019} and 26-08-2021 for account^{no. 14820510000458 thereby confirming the correctness} of the balance held by the applicant^{Bankand acknowledged their liabilities in the} account no. 14820500008776^{and the account14820510000458 respeciively. After} the accounts became^{NPAthe applicantbank issued noticesfor repaymentof the due} amount, but the defendants^{have neither chosenfor repayment of the loan amounlnor} approached lo the applicant^{bank for renewal of the cash credit loan account.}

The applicant bank thus^{became constrained to file the presentOriginalApplication} for lhe recovery of Rs.^{2,50,80,279.07 (RupoesTwo Crore Fifty LacsEighty} Thousand Two Hundred^{Seventy Nine and PaisaSeven)only as on'10'022022} along with interest and^{cost ofthe application.}

After filing of the^{OA the Tribunal issued notices upon the defendants through} registered^post and^{the applicant bank filed service reporton 25'05 2022 and brought} on record lhe^{postal receipts alongwith track consignment report lt is observedthat} the summons^{have not been served uponthe defendants ThereaftertheTribunal} ordered^{paper publicationof notice uponthe defendants and theapplicantbank} issued notices^{to the defendantson 02.06.2022through Paper Publication in two} newspapers namely^{"IheArunachatImes" and "Echo of Arunachal'Evenafter} issuance of notic€s^{uponthe defendantsthrough paper publication also there was no} representation^{on behalf of the defendants either by the counsel or the personand} hence the defendants^{were madeset ex-parteon 03 08'2022 and their right to file} written statement^{cum evidenceon affidavitwas closed and the matter was posted for} hearing on behalf^{of the applicantbank'}

Supporting the claim ofthe applicant bank Sri Prashant Kumar, Chief Manager of the Applicant Bank has filed evidence on affidavit mupled with the security documents marked as Exhibit^-P, Exhibit AW-1 to AW-'100 supporting the claim of the applicant bank.

Considering the^{facts and circumstanc€s of the case, I am of theconsidered} view that the^{documentsfiled by theapplicant bankare supporlingihe claimof the} applicant bank^{and establishing the liability of the defendants lt is provedthat the} defendants^{are liableto pay to the applicant bankthe claim madein the Original} Application.^{The loanswereobtained and documentshave beenexecutedon} 06.04.2004,^{02.03.2006,26 03 2007"18 03 201o',11'O42011',28'03 2012'} 08.03.2013.^{Acknowledgementof Debt and Security Letters are dated10 03 2010'} 23.06.2010,^{01.02.20'16, 2101'20'tg'26 08'2021' 28 03'2012',01 022016'} 21.01.2O1g^{and 26'082021 The accounts became NPA on 31 032021 and the OA} has been^{filed on 11 04 2022' Hence' the OA is Iiled well withinthe period of limitation} and this^{Tribunal havinga jurisdictionto adiudicatethe OriginalApplication}

WRC Field; South: NH-52 A Road; East: Maruti Ghypsy Garage and property of Ralum Borang; West: PWO Office and Circular Office;

(ii) all that piece and parcel of a plot of land measuring 15OO sq. mtr covered under land allotment order No. DC/ICC/LM-I So8pOlS dated 03.02.20,16, Plot/Dag No.205, Sheet No. Jp.l situated at village papul Hill, DistNaharlagun, Arunachal Pradesh standing in the name of Toko Tallo, S/o Toko Tass which is bounded by North: Slope area; South: property of Sh. S.Tajo; East: Property of Sh. H.R.Talo; West:^property of Sh. T. Jamoh, as described in Schedule-B of the OA till the amount is realized in tult.

iv) The applicant bank is entifled to proceed against the secured ilems towards recovery of the debts.

v) The applicant bank is also entifled to proceed against the personal assets and properties of the defendants towards recovery of the dues.

vi) The applicant bank is entitled to the costs of the O.A. which includes the advocate fees of the applicant bank. Applicant is directed to file the cost memo within 2 weeks from today.
