(B) Total land measuring 100 Kanal owned by defendants No.2 and 3, detailed as: (i) Land measuring 82 Kanal 06 Marla situated at Village Muthian Wala, Tehsil Patti, District Tarn Taran, Punjab, detailed as: (a) Land measuring 43 Kanal 06 Marla owned by defendants No.2 and 3; and (b) Land measuring 39 Kanal 00 Marla owned by defendant No.2; (ii) Land measuring 17 Kanal 14 Marla situated at Village Jhugian Noor, Muhamod, Muthian Wala, Tehsil Patti, District Tarn Taran, Punjab detailed as: (a) Land measuring 12 Kanal 06 Marla; and (b) Land measuring 05 Kanal 08 Marla owned by defendant No.3. Documents executed:- D.P. Notes, Letters of Continuity, Agreement for Term Loan cum Guarantee cum Hypothecation and Agreement for Overdraft/ Cash Credit cum Guarantee cum Hypothecation all dated 23.12.2014, which are Annexures A5 to A10 to this OA; D.P. Note, Letter of Continuity and Agreement for Overdraft/ Cash Credit cum Guarantee cum Hypothecation all dated 24.02.2017, which are Annexures A12 to A14 to this OA; Addendum-cum-Undertaking dated 17.02.2017, which is Annexure A16 to this OA; Legal Notice with postal receipts dated 25.04.2022, which is Annexure A17 to this OA and Statements of accounts along with the certificate, which are Annexures A18 and A19 to this OA. 5. The loan accounts became irregular and were classified as NPA and after adjusting debit and credit entries in loan accounts there was a debit of Rs.81,00,735.00, which is recoverable and the defendants were served recall notices but they did not repay the outstanding amount, therefore, the applicant bank requested to accept the application and to issue Recovery Certificate accordingly. 6. The defendants were served notices to appear before this Tribunal but no one appeared on behalf of defendants and they were proceeded ex-parte on 30.08.2023.
