Heard on MA No.22/2022 for restoration of SA No.44/2019, which was dismissed in default on 24.08.2022 on account of the non-appearance of counsel for the applicant. The present MA was filed on 29.08.2022. Respondent has not filed reply to SA.
As per the application, counsel for the applicant was present in the court on 24.08.2022. However, due to ill health, he started feeling unwell and left the court and thereafter, the present SA was dismissed in default.
Taking into consideration the averments of the application, the MA is allowed and disposed of. sA No.44/2019 is ordered to be restored to its original number.
