Order with the Signature of the Court MA 182 of 2022 Yashwant Singh Vs. UCO Bank Ld. Counsel Dr. B.K. Singh for the Applicant is present. Ld. Counsel Shri R.K. Pandey for the Respondent Bank is also present. The present Misc. Application has been filed by the Applicant for direction against the Respondent Bank to comply the order dated 20.11.2019 issued by the Recovery Officer in R.P. Case No.307 of 2012. Copy of that order has been filed as Annexure No.2 of this misc. application, while ld. Counsel for the Respondent Bank has pointed out that the present Misc. application has not been filed against R.P. No. 307 of 2012. Apparently it is mentioned in the application itself that Misc. Application is arising out ofR.P. No. 391 of2012 and OA No. 284 of2011. It is further submitted that the Applicant is not co-operating in hearing before the Recovery Officer and he is taking adjournments and moving frivolous applications before the Recovery Officer. The forum of misc. application is not available for getting the order of the Recovery Officer complied. If the Applicant has any grievance against the order of the Recovery Officer he may file Appeal, if it is permissible under law. In view of the above circumstances the present Misc. Application is not maintainable and is dismissed. Considering the facts and circumstances of the case no order as to cost is being passed, however, it is directed that the parties shall not take adjournments before the Recovery Officer and shall co-operate in the hearing of the Recovery Case. Let the copy of the order be sent to the Recovery Officer to ensure the early disposal of the RP case. Interim order, if any stands vacated. File be consigned to record room.
