Heard on MA No.13/2023.
In this case parties had compromised the matter in the Lok Adalat held on 14.05.2022. However, defendant did not make the payment. Now bank has filed this MA for issuance of recovery certificate. In this case notice was given to the borrower, which has been duly received. Accordingly, recovery certificate be issued as per amount mentioned in the Original Application with interest and costs. Parties are directed to appear before the concerned Recovery Officer on 10.07.2023. Bank can recover its dues by the sale of mortgaged/hypothecated properties mentioned in the OA. Accordingly, the MA stands disposed of.
File be consigned to record room after due compliance.
