| Looking to the fact since liquidator is appointed by Hon’ble NCLT for defendant no. 1 as well as personal insolvency proceeding has been initiated for defendant no. 2 before the NCLT and these two defendants are only contesting defendants in the present OA. Therefore, in my view there is no substance to continue the present OA as of now as moratorium will be applicable on the present proceeding, and thus same is hereby disposed off with the liberty to the applicant bank to |

revive the same as and when required. The IA No. 1389/2022 is hereby dismissed and in case the OA revive, the applicant may take the fresh steps.
