Heard the Appellant and perused the record.

Instant appeal is preferred against an order dated 01.01.2026 passed by Learned DRT-I, Hyderabad whereby interim protection was granted to the Appellant subject to payment of Rs.4.20 lac on or before 9.01.2026, Rs.4.20 lac to be paid on or before 23.1.2026. In case of default, interim order shall stand vacated.

Learned Counsel for Appellant would submit that thumb impression of the Appellant was obtained by misrepresentation on the release deed by third party who is neither borrower nor guarantor and she is in the possession of the secured assets. It is further submitted that the conditions imposed by the Learned DRT are harsh.

S.A. filed by the Appellant states that the registered release deed was fabricated by the sons and daughter of the Appellant; meaning thereby that challenge is about the execution of the release deed which is under misrepresentation or fraud. At this stage it cannot be accepted that the deed was not executed by the Appellant which is yet to be finally decided.

As far as interim protection is concerned, Learned DRT has already taken a very lenient view by granting time as well as instalment to the Appellant which order does not warrant any interference but only modification is that the amount shall be deposited with the Registry of DRT-I, Hyderabad. Period fixed by the Learned DRT is extended to 23^rd February, 2026 for the first instalment and 2^nd March, 2026 for the second instalment. With this modification, appeal is disposed of at the ‘Admission’ stage.
