The matter is taken up for hearing by way of praecipe filed by the appellants for seeking urgent relief.
The Learned Counsel for the Appellants would submit that he has received instructions to withdraw the present Appeal and seeks permission to withdraw the same.
The Respondents have no objection to the same; however, they would submit that the amount deposited by the Appellants under Section 18 of the SARFAESI Act be paid to the Respondent Bank. They would further submit that a separate Misc. Application shall be filed for this purpose.
Therefore, Misc. Appeal No. 172/2024 is dismissed as withdrawn without prejudice to the rights of the respective parties to this Appeal.
