The Learned Counsel for the Appellants would submit that I.A. No. 825/2024 has been filed seeking condonation of the delay in filing the present Appeal.

The Learned Counsel for Appellants would further submit that the impugned order was passed on 15.04.2024, and the Appeal came to be filed on 26.07.2024. It is further submitted that the certified copy of the impugned order was applied on 22.04.2024. The same was made ready on 04.06.2024 and delivered on 27.06.2024.

The Learned Counsel for the Appellants would further submit that during the intervening period, the father of Applicant/Appellant No. 1 suffered a brain stroke, and Applicant/Appellant No. 2, being the wife of Applicant No. 1, was attending to him. It is further submitted that the father of Applicant No. 1 subsequently expired.

The Learned Counsel for Appellants would submit that there is a delay of 29 days in filing the Appeal, and the same may be condoned.

The Learned Counsel for the Respondent vehemently opposes the Application.

Upon hearing the submissions and considering the reasons stated, this Appellate Tribunal is satisfied that sufficient cause has been shown for the delay.

Accordingly, the I.A. No. 825/2024 is allowed and the delay of 29 days in filing the Appeal stands condoned.

The Respondent is granted four weeks’ time to file a reply, if any, with an advance copy to the other side.

The rejoinder, if any, shall be filed within three weeks thereafter, with an advance copy to the other side.

List the matter on 11.08.2026 before the Ld. Registrar.
