The Learned Counsel for the Respondent would submit that an application being I.A. No. 81/2026 whereby the Respondent has prayed for setting aside the order dated 12.11.2024 directing the to conduct the proceeding against the Respondent ex-parte.

The Learned Counsel for the Respondent would submit that the Respondent could not appear in the matter on 12.11.2024 as he was held up in another court and by the time he came to the court, the case had already been called and the proceedings were directed to be conducted ex-parte against him.

The Learned Counsel for the Appellant would submit that the application may be allowed subject to the costs.

Accordingly, I.A. No. 81/2026 is allowed and the order dated 12.11.2024 is hereby set aside subject to payment of costs of ₹20,000/to the Prime Minister’s Relief Fund, to be deposited within one week
