The matter is taken up for hearing by way of praecipe filed by the appellants for seeking urgent relief.
The Learned Counsel for the Appellants would submit that the matter has already been settled and that he has received instructions to withdraw the present Appeal and seeks permission to withdraw the same.
The Learned Counsel for the Appellants would further submit that the amount deposited under Section 18 of the SARFAESI Act may be refunded to Appellant No. 1.
The Learned Counsel for the Respondent has no objection to the withdrawal of the present Appeal and to refund the amount to the Appellant No.1
